JVFD may conduct online or in-person charitable raffles, drawings, giveaways, and similar fundraising activities only as
permitted by applicable law.
West Virginia law contains specific requirements governing charitable raffles and online charitable raffles, including
licensing, recordkeeping, reporting, and operational requirements. Online raffles conducted by JVFD are subject to
applicable provisions of West Virginia law, including W. Va. Code Chapter 47, Articles 21 and 21A, as applicable.


Each raffle, drawing, giveaway, or contest may have separate official rules, including entry periods, ticket prices, number
of entries, prize descriptions, drawing procedures, winner-selection methods, eligibility restrictions, pickup or delivery
requirements, taxes, and other conditions. Those specific rules are incorporated into these Terms for that offering.
JVFD reserves the right to reject or void an entry, transaction, or purchase when required by law, when payment is not
successfully completed, when eligibility requirements are not satisfied, when fraud or misuse is suspected, or when an
error materially affects the integrity of an offering.
Unless the applicable rules expressly state otherwise, purchasing more tickets or entries increases the number of
chances but does not guarantee that a participant will win.

6. Purchases, Payments, and Transaction Processing
You agree that all information you provide in connection with a transaction will be accurate, current, and complete. You
authorize JVFD and its service providers to process the transaction and any information reasonably necessary to
complete it.
JVFD may use third-party payment processors and other service providers to accept and process payments. Those
providers may impose their own terms, privacy practices, prohibited-business rules, transaction limits, identity-verification
requirements, or other restrictions.
JVFD may modify, suspend, cancel, or decline an offering or transaction when necessary to comply with applicable law,
licensing requirements, processor restrictions, fraud-prevention measures, or other legal or operational requirements.
A transaction is not final merely because a payment attempt was submitted. JVFD may require successful payment
confirmation and any required eligibility verification before recognizing a purchase, entry, or prize claim.

7. Refund and Cancellation Policy
Except where required by law or expressly stated in the rules for a particular offering, all purchases, ticket sales, entries,
donations, and other payments made through the Site are final and non-refundable.
If JVFD cancels an event, raffle, drawing, or other offering, JVFD may provide a refund, substitute arrangement,
rescheduled date, or other remedy when required by law or described in the applicable rules.
Chargebacks, payment disputes, or attempted reversals do not automatically cancel obligations or determine eligibility.
JVFD may investigate disputed transactions and take reasonable steps to prevent fraud or misuse.

8. Prizes, Taxes, and Winner Verification
Prize winners may be required to provide valid identification, contact information, tax information, proof of eligibility, or
other documentation before receiving a prize.
Unless otherwise stated or required by law, winners are responsible for applicable federal, state, and local taxes, fees,
registrations, licenses, transfers, insurance, transportation, or other costs associated with accepting or using a prize.
JVFD may issue any tax forms or reports required by law and may withhold amounts when legally required. Failure to
provide required information may delay or prevent delivery of a prize.

AND NON-INFRINGEMENT.

14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JVFD AND ITS OFFICERS, DIRECTORS,
MEMBERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR
INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR
RELATING TO THE SITE OR YOUR USE OF IT.
TO THE EXTENT A LIMITATION OR EXCLUSION OF LIABILITY IS NOT PERMITTED BY APPLICABLE LAW, THAT
LIMITATION OR EXCLUSION WILL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED.
Nothing in these Terms is intended to limit liability that cannot legally be limited or excluded.
15. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless JVFD and its officers, directors,
members, employees, volunteers, agents, and service providers from claims, liabilities, damages, losses, costs, and
reasonable attorney's fees arising from your unlawful or unauthorized use of the Site, your violation of these Terms, your
violation of another person's rights, or fraudulent or improper activity attributable to you.


JVFD reserves the right to assume control of the defense of a matter subject to indemnification, in which case you agree
to reasonably cooperate.
16. Dispute Resolution and Arbitration
Before initiating formal proceedings, you and JVFD agree to make a good-faith effort to resolve a dispute informally by
contacting the other party and describing the dispute and requested resolution.
To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or the Site that cannot be
resolved informally shall be resolved by final and binding arbitration under the Federal Arbitration Act before a single
neutral arbitrator. Unless the parties agree otherwise, arbitration will be administered by the American Arbitration
Association or another mutually agreed arbitration provider under applicable consumer or commercial rules.
This arbitration provision does not prevent either party from bringing an individual claim in small-claims court when
eligible, seeking emergency or provisional relief when permitted by law, or exercising any right that applicable law does
not permit to be waived.
The enforceability, interpretation, and scope of this arbitration provision will be determined as provided by applicable law
and the rules of the selected arbitration provider.

17. Class and Representative Action Waiver
TO THE EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS. NEITHER
YOU NOR JVFD MAY BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR
REPRESENTATIVE ACTION OR ARBITRATION AGAINST THE OTHER UNLESS BOTH PARTIES EXPRESSLY
AGREE OR APPLICABLE LAW REQUIRES OTHERWISE.
If any portion of this class-action waiver is determined to be unenforceable, the remaining provisions of these Terms will
continue to apply to the maximum extent permitted by law.

18. Governing Law

These Terms and your use of the Site are governed by the laws of the State of West Virginia, without regard to conflict-
of-law principles, and by applicable federal law.

For any dispute that is not subject to arbitration, you consent to jurisdiction and venue in a court of competent jurisdiction
in West Virginia, subject to any contrary requirement imposed by applicable law.
19. International Users and Geographic Restrictions
The Site is operated from the United States. If you access the Site from outside the United States or outside West
Virginia, you are responsible for complying with laws applicable to you.
Certain fundraising activities, raffles, contests, prizes, or purchases may be limited to specific geographic areas. Access
to the Site does not mean that every offering is lawful or available in your location.

20. Termination and Access Restrictions
JVFD may restrict, suspend, or terminate access to the Site or any portion of it when reasonably necessary to protect the
Site, enforce these Terms, comply with law, address fraud or misuse, or protect JVFD or others.
Provisions that by their nature should survive termination, including intellectual-property provisions, disclaimers,
limitations of liability, indemnification, dispute provisions, and governing-law provisions, will survive.

21. Severability; No Waiver; Entire Agreement
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted by
law and the remaining provisions will remain in effect.
JVFD's failure to enforce a provision does not waive the right to enforce it later.


These Terms, together with the Privacy Policy and any official rules or additional terms applicable to a particular
transaction, raffle, drawing, giveaway, contest, or event, constitute the agreement between you and JVFD concerning the
Site and supersede prior communications concerning the same subject matter.

22. Changes to These Terms
JVFD may update these Terms from time to time to reflect changes in the Site, services, fundraising activities, payment
processing, legal requirements, or organizational practices.

All Sales Are Final

Payment Disputes and Chargebacks

Fraudulent, improper, or unauthorized chargebacks may result in cancellation of associated entries, tickets,
transactions, or eligibility, to the extent permitted by law.
